On August 19, 2016, defendants again sought dismissal of the lawsuit. This time – defendants’ second attempt – defendants argued that plaintiffs’ original complaint failed to state any viable claims. Defendants asserted that even if the plaintiffs’ allegations were true, the law would not support a finding that UberBLACK drivers are employees entitled wages and reimbursement of expenses. Defendants also argued that they did not owe a fiduciary duty to plaintiffs.
