The original class action complaint was filed on January 6, 2016 in the Philadelphia Court of Common Pleas. The action claims that Uber and Gegen exert an enormous level of control over UberBLACK drivers in Philadelphia. As a result of this control, the drivers are legally employees, and not independent contractors. Therefore, the drivers should be paid wages and reimbursed for business expenses.
